ATSSA reiterates need for driver attention in work zones following six recent deaths

ATSSA President & CEO Stacy Tetschner expressed his condolences to the families who lost loved ones in last week’s tragic work zone incident in Baltimore County, Md., in which six people were killed.

“ATSSA is deeply saddened by yet another tragedy that resulted in the loss of essential workers within our industry.  More important than being workers, these individuals had families and loved ones they did not return home to. Our thoughts and prayers are with the families and loved ones of Sybil Lee Dimaggio, Carlos Orlando Villatoro Escobar, Jose Armando Escobar, Rolando Ruiz, Mahlon Simmons II and Mahlon Simmons III.”

The six workers were killed March 22 in Maryland while working to improve a roadway and ensure the safety of all road users. 

“This devastating event serves as a stark reminder of the importance of work zone safety and the risks faced by roadway construction workers every day. It is crucial that the industry and the driving public come together to prevent future tragedies like this one from occurring,” Tetschner said.

ATSSA notes need for flexibility in final rule for Buy America requirements

Letter to OMB seeks clarity on proposed rule, emphasizes impact on roadway safety

ATSSA provided feedback to the Office of Management and Budget on Sunday regarding the proposed rules for Buy America requirements, asking for clarification on four specific issues and noting the importance of roadway safety infrastructure at a time when traffic fatalities are a major issue nationwide.

“ATSSA members are generally in favor of increasing the capacity to procure domestically-sourced construction materials and manufactured products for use on surface transportation projects,” ATSSA President & CEO Stacy Tetschner wrote to Deputy Controller Deidre A. Harrison. “However, ATSSA members are deeply concerned with the breadth and scope of the [Notice of Proposed Rulemaking] and the impact it could have on the timely and cost-effective delivery of much-needed roadway safety infrastructure improvements.”

The letter is in response to the NPRM on Guidance for Grants and Agreements – 2 CFR Parts 184 and 200 (Docket No. 2023-02617), which was published Feb. 9. The letter notes that ATSSA members manufacture, distribute and install roadway safety infrastructure devices such as guardrail and cable barrier, traffic signs and signals, pavement markings, work zone safety devices.

“It is important that any new Buy America requirements not have the unintended consequence of hindering the delivery of important roadway construction and roadway safety projects across the country,” Tetschner wrote.

Thousands of roadway safety advocates filled the Phoenix Convention Center this week for ATSSA’s 53rd Annual Convention & Traffic Expo, exploring the latest technology and equipment for protecting lives within work zones and on the nation’s roadways.

A record-setting number of people registered, with more than 3,700 for this year's event.

With nearly 50 education sessions to choose from, they gained both practical tips—such as how to negotiate contracts to limit liability—and enhanced their understanding of critical workplace safety and technology issues such as advances in communication between work zones and connected and autonomous vehicles (CAVs).

Keynote speaker Scott Wozniak, an organizational leadership expert from Atlanta, addressed a key workforce issue on Sunday when he offered insights for building a successful team by focusing on the essential element of employee engagement.

Transportation veteran confirmed as FHWA leader

Shailen Bhatt, who led state transportation departments in Colorado and Delaware, was confirmed by the Senate to lead the Federal Highway Administration (FHWA).

Bhatt’s confirmation by the full Senate on Thursday follows bipartisan support on Nov. 29 by the Senate Environment and Public Works Committee.

As head of the FHWA, Bhatt will oversee implementation of the $1 trillion Infrastructure Investment & Jobs Act (IIJA) passed into law in November 2021.

Legislative Briefing & Fly-In returns to nation’s capital after two virtual events

ATSSA members from across the country are meeting with legislators on Capitol Hill today, carrying their insights and priorities for roadway safety directly to lawmakers.

Sixty meetings are scheduled with members of the Senate, the House of Representatives and their legislative teams. The goal is to fuel the future of roadway safety by carrying their message directly to the nation’s decision makers.

ATSSA’s two-day Legislative Briefing & Fly-In returned to Washington, D.C., this week after two years as a virtual event because of the COVID-19 pandemic.

More than 50 people representing 17 states and the District of Columbia registered to attend the event, which is a benefit of ATSSA membership.

ATSSA releases Special Report on raw materials issue

ATSSA today released a Special Report on the raw materials shortage, which found that nearly 92% of members who responded to a recent survey were experiencing a shortage and 90% expect the situation to continue for at least six more months.

The report, “ATSSA Raw Materials Update,” is the result of three member surveys, the most recent of which was conducted in April. The percentage of members impacted by the raw materials shortage has increased with each survey, going from 75% in the first survey in March 2021 to 88% in June 2021 and now above 90%.

“Each of the ATSSA surveys showed that raw materials shortages were having a major impact on members who are directly engaged in providing roadway safety infrastructure, which poses a nationwide safety risk because their work is designed to save lives on streets and highways across the country,” the report states in its conclusions.

Traffic fatalities rose an estimated 10.5% in 2021, reach 16-year high, NHTSA reports

Traffic fatalities across the U.S. rose 10.5% in 2021 to a projected 42,915 deaths, reaching a 16-year high, according to statistics released today by the National Highway Traffic Safety Administration (NHTSA).

That projected increase from 38,824 fatalities in 2020 is “the highest number of fatalities since 2005 and the largest annual percentage increase in the Fatality Analysis Reporting System’s history,” NHTSA announced today.

ATSSA President & CEO Stacy Tetschner expressed concern over the record-breaking fatality rate.

“ATSSA’s members have devoted their lives to roadway safety and providing the infrastructure and technology needed to save the lives of the motoring public as well as men and women working on our roadways,” Tetschner said. “This unprecedented increase in traffic fatalities brings home the importance of our work and the necessity of government and private industry partnering to provide safe thoroughfares. The bipartisan Infrastructure Investment and Jobs Act (IIJA), which was enacted into law in November, provides historic levels of federal funding for roadway safety infrastructure projects. Departments of transportation around the country, including the U.S. Department of Transportation, must prioritize getting these funds to critical, lifesaving safety projects as soon as possible. We know that safer roads save lives. ATSSA members are ready to go to work with their agency partners to move toward zero deaths on all roads.”

ATSSA urges DOTs to support a standardized form for QPL and APL

ATSSA President & CEO Stacy Tetschner reached out to the leaders of departments of transportation (DOTs) in all 50 states asking for their support for a standardized form for the Qualified Products List (QPL) and the Approved Products List (APL).

In a letter, Tetschner explains that a standardized form would help roadway safety products get to market faster by streamlining the current burdensome process of making a different application for every DOT across the country.

"If you are not aware, each DOT manages its QPL/APL submittals, reviews and approvals differently and this means each company wishing to see a product added to the list must go through the process 50 times, frequently in different ways with different forms, resulting in a very time-consuming, labor-intensive process,” Tetschner states in the letter. “This burdensome process delays getting new and improved products onto the roadways where they could save lives.”

The letter is signed by the president of each of ATSSA’s Chapters, which represent 1,500 member companies from across the country as well as many public agencies.

ATSSA president contacts DOT leaders amid soaring fuel costs and record inflation

ATSSA President & CEO Stacy Tetschner contacted the leaders of every state’s department of transportation (DOT) requesting contract price adjustments for ATSSA members in light of the rapid increase in fuel costs, significant inflation and the volatility of the situation.

“We strongly encourage you to consider immediate action to help remediate the effects of the recent and rapid increase in fuel costs across the country, most specifically as it affects the roadway industry, where roadway projects that were bid months ago are now being awarded and businesses are experiencing losses due to inflationary operational costs,” Tetschner wrote in the April 8 letter.

Tetschner notes that inflation “is at a four-decade high and gas prices continue to increase,” having increased 45% over this time one year ago.
