Over the last decade, many prime contractors have learned to transfer all or part of their liability onto to our members. This comes in the form of a contractual indemnity clause, often in a take-it-or-leave environment. Many members are either unaware or have been encouraged to take on this inappropriate responsibility. Inherent in this practice is a disincentive for the prime to ensure safety practices, knowing they can pass negligence to their traffic control subcontractors. The result has been a catastrophic impact on members claims, ensuring future skyrocketing insurance costs.
